Shoplifting, Larceny, Robbery, Theft Diversion for a second time?

I was caught stealing at walmart two days ago. The amount was only $60, so I believe this is retail fraud in the 3rd degree. My question is that I have already completed a diversion program in the past for the same offense, however it was in a different county than this incident is. Is there any possibility that I will be able to get diversion again with the help of a lawyer because the second incident happened in a different county?

Is it impossible to never steal?

Plead not guilty, admit nothing, request a public defender, and stop breaking their laws.
 
I am a Retail Theft consultant and answer questions like yours daily. Diversion is a one time thing. However if for any reason (doubtful see earlier reply) the county for current case does not become aware of previous Diversion then you could get a second shot at this. You need to discuss this and other options with an Attorney
