Divorce/car dispute

I went through a divorce about a year ago. In my divorce papers, it clearly states that my ex is responsible for making the rest of the payments on my vehicle, which was awarded to me. The only way I could possibly lose the car at any point, is if I didn't have insurance. Needless to say, I have maintained the insurance.
A few days ago, I woke up and my car was gone. I called my ex and discovered he hadn't made the payments for about three months. It was repossessed. Is he still obligated to get the car back? Would he have to replace the vehicle if he cannot get it back?

He is certainly in contempt of the order, so you can file for that. It seems only fair that he should have to replace the vehicle, but it's hard to say how a judge will rule after hearing both sides.

Perhaps if you warn him that you plan to file, he'll get the car back. Good Luck.

Beware that if he is found in contempt and wants to correct this situation, he will probably get you a car - probably not the same car you used to have since the dealer or whomever he purchased from might have already found a buyer for it and will probably be no longer available for you to take back. Hope this helps!
