My friend's ex-husband died on Sept. 1st, 2009. As a part of her divorce decree, she was to be the sole beneficiary of the life insurance policy that he maintained during their 15-year marriage, in addition to the alimony he was ordered to pay by the court.
After 2 months with no alimony payment received and getting no response from the court or from the laywer she had retained in July '09, she was finally informed by her lawyer on Dec. 14th after numerous phone calls, emails and visits to her office, that her husband and died and had in fact remarried shortly before his death.
From the insurance papers she was in possesion of, she read that to receive benefits, you must notify the insurance company within 90-days from the date of the death of the insured.
She was never contacted by anyone concerning his estate and is worried that his new wife may have cashed-in the insurance claim.
What recourse does my friend have?
