My children and I are unhappy in Mass. I have talked to my ex-husband about me taking the kids and moving to Florida. In the divorce it says he has to pay the kids medical, I told him if he writes up a paper and gets it notorized stating i can leave with the kids i will do the same but state i will take responsibility for the medical. He says we will still have to go to court because we can't override what the judge ruled. If we are agreeing to the terms do we have to go to court or are the notorized letters good enough?
 
Not really. You really need to go to court. Since you are wanting to move the kids so far it would me more than fair for you to make him a good deal. He will see the kids less. Also who is going to pay for transportation for visits? What happens if you fail to provide medical insurance like you agreed? trading medical formoving is unusual. i would leave it the way it is if you ex has good insurance. You could offer him to claim one or both of the kids for tax purposes instead, and you also need to find out who is going to do what for transp. This really should be singed by a judge. If you both agree it should not be expensive.
