My jurisdiction is: New York
My husband and I signed a prenup agreement. We know each other for 30 years but have been married since 2003. In 2004, he was arrested for physical abuse. At that time, he said he was sorry and so I dropped the charges against him. He was mostly verbally abusive after that but nothing like he was back in 2004. On sunday, March 22nd, he pushed me and I fell and broke my knee cap. He told me to wait till Monday to go to the doctor because the emergency room would probably tell me the same thing. On Monday, I went to the orthopeadic and he took an xray and told me I had a broken kneecap and would need either a cast or brace to wear for 6 weeks. I just told the doctor that I fell but did not go into any detail. My question is that if I seek a divorce, I will have no where to go because the prenup states my husband owns the properties. Can I sue for damages due to personal injury even though I have no legal rights to the property?
