I have an apartment with my husband. I am not leaving in the apt since our separation 1 year ago. We have a verbal agreement that he would pay for mortgage and HOA (he is current w/ the payments). Now I want to file for divorce and does not matter to me if he wants to keep the apt but, he is saying that he can make me responsible for half of the payments. Am I responsible if iam not leaving there? Not sure what to do.

If your name is on the mortgage then yes he can have you pay. If you dont pay and he does not pay, welcome to foreclosure.

you might want to put the condo for sale or both move out and rent it if neither of you want to make the payments.
