My husband and I have resently decided that we can not remain together. We have a 6 year old daughter. I am wanting to know what our rights are? How long do we have to remain seperated before divorce? Spliting up of personal property, we have a home together which we are going to put on the market. We own 1 vehicle that is in my name, because it is in my name does that mean that its mine or because we got it well together that i have to buy him out?
Just in general what are my rights? Right now we are both saying that we want to get along for our daughter but i have seen many people start with good intentions but sometimes they don't last.
Any help would be greatly appericated.

What state do you live in? Different states have different requirements for divorce.

Until there is a court order regarding custody and visitation, both of you have equal rights to the child.

Generally, all marital assets and all marital debts will be divided. You may not have to buy him out of the car, but he will probably get something else of equal value to compensate.
