Does a spouse who is no longer in the Military, who never retired who is going through a divorce proceeding have to report medical compensation that is non taxable as earnings to a divorce master? The spouse's DD-214 has HONORABLE discharge not medical discharge. Does this spouse have to discuss anything pertaining to medical compensation?

It all depends on how the question is asked of you. be very careful if you're answer is perceived as being deceitful or concealing.

Disability related pensions are usually protected, so if it were me, I'd revceal it. besides, your "soone-to-be-ex-spouse" most likely is aware of it anyway.

She/he will blab and try to make you look like a liar or a infer that you committed perjury.

Go ahead and reveal it, they will have a hard time getting VA or DoD disability benefits.

You might also be wise to speak with a local attorney about this.

Thanks for your quick response. I have another question, A spouse has been evicted from the house and a Protection from Abuse order placed on the spouse. Can the spouse legally fight for a house that they have been evicted from? Can the other spouse refuse the division of the home? Keep in mind that they have been seperated for over three years, but was still living in the same marital home until the courts evicted the spouse due to abuse. Also be mindful that they both share equal physical legal custody of their two children, but the spouse who is residing in the home at present children live there as well.
 
The order of protection will keep one spouse away. It us rare to get such orders overturned. Besides, why go where it could lead to trouble for yourself?

The other spouse can resist the sale of the home, but eventually a judge will order such a sale, if the parties fail to agree.

I suppose exchange of the children will eventually have to be done at a police station.
