Divorced but still on home loan

Hello all! Thanks for reading. I divorced from my ex back in '03 in Michigan. I had signed on the mortgage and his car loan because his credit wasn't so great when we were together... which ended up being the worst decision I ever made.

Since then, I have been attempting to make a new life for myself in Washington state. I never got a lawyer during the divorce because I had no money of my own as he had everything. I signed over the deed to the house thinking that would absolve me of the debt at the time. Of course, that was incorrect and I am now still today on the home and car loan which he is making continually making late payments on.

He had promised me he would refinance the house and car into his own name. He has since remarried but this still has not happened. We also have no contact with each other. I hired a lawyer after saving some money last year to force him into selling or refinancing. We won the case but he then filed bankruptcy after the case so that wiped him of that obligation and I was out all of the lawyer fees. My lawyer said the case was closed and pretty much said I'm out of luck? Not sure why.. I just sat on it awhile hoping he would start making payments on time.

My credit has been through the ringer, and I will not be able to get a loan for a house or car on my own. I know something needs to be done but I have no idea what. Do I try to file bankruptcy .. is that my only option? All of my debts are perfectly paid on time as I work hard to make sure that they are except his debts. Even after his bankruptcy chapter 13 i believe it was.. he still is not making the payments on time. Or should I bring him back to court again and try to force him to refinance once again? I know it may be cheaper to file bankruptcy but I feel in the long run that would effect me worse and I really just want to have my life back.

Any advice is much appreciated!! Thanks so much!!

Q: My lawyer said the case was closed and pretty much said I'm out of luck? Not sure why...

A: Because he filed bankruptcy and left you with the debt.

you probably are going to have to take him to court to force him to refi into his name. As long as your name is on the mortgage, your credit is affected.

thanks.. i just wasn't sure if I could take back to court again since my lawyer did not suggest that being an option. I will talk to one again and see if we can finally get me off of it.

For the post above that one - It was said to me like I didn't have any other options, not about the lawyer fees. That is why I said not sure why.

Thanks guys!
