do I have a case for defamation

An employee at work, filed a police report on me for assault. In June 8, 2009 for an alledged assault that supposedly happened on May 18, 2009. My work place me on Administrative duties, during which time I lost in pay approximately 10k. On September 29, 2009 the local police closed the case due to inconsistancies in her story.
Some of the inconsistancies were- the time line, she did not report alledged incident for a total of 9 shifts that she worked, she told the detective she reported it immediately, in a workers comp claim, she made no reference to any injuries sustained at work until 6/26/09, she currently states she still suffers from pain, however in doctors notes it is noted that her neck is doing better.
After making the initial report to police she regularly cancelled appointments for follow up interviews, would not provide documentation of any injuries nor any witnesses that could verifiy her story although there were people in the location where she said this assault happened.
Due to this allegation, I have lost money, the respect of co-workers and still face possible administrative sanctions because I am a supervisor and this unfounded and very false allegation has caused me to be ridiculed and caused alot of stress due to the severity of the allegation.
 
yes, along with anything to recover from the stress and ridicule i have had to deal with for the last 5 months and until I can actually start earning my normal pay.
 
Were charges filed against you and later dismissed, or did she just make a police report that was being investigated?

If there are false claims in the police report that you can prove, and those claims were directly related to your loss, then maybe you could get something from her.

I think your focus should be more toward your employer. If charges were not filed by the DA and you were never arrested, they might have some liability for your loss. If the police dropped the investigation then I doubt your employer would have grounds to sanction you in any way.

Considering the amount of your loss and how messy this looks... this is the sort of thing you should consult a local attorney for. Get yourself a copy of all police reports if you haven't already. However, if in the end it comes down to your word against hers, it likely won't go far. I am not so sure that your employer is in the clear though.
