Do I have the right to return the car and get my money back?

I purchased a used vehicle at an Acura dealership. I purchased the extended power train warranty with the vehicle. On my way home from the dealership the day I purchased the car the car made some weird noises which sounded like transmission issues. The next morning I heard the noise 2 more times. I called the dealer and they said to bring the car in for a diagnosis. They had found out the issue was "torque converter shudder" which causes the car to feel like it's trying to shift I to a gear without using a clutch then sputters for a few seconds after that happens. The service dept said this is part of the power train but this isn't something they fix and I would have to deal with the nuisance that it is because the car is a "older vehicle" 2005. So I have purchased a warranty on the power train and the dealer is telling me they are not going to fix the power train issue??? So every now and then while driving at a normal 35mph I have to "deal with the nuisance of my car feeling and sounding like it's going to fall apart. This seems completely unacceptable and seems to me to be a breach of contract. I have had it and just want my money back. I have had the car for a day and a half.
 
You should have had YOUR mechanic investigate the vehicle.

Your state's AG handles these complaints, but its an 8 year old car.

I see difficulty unloading this YELLOW, citrusy thing.
 
Did you drive the car before buying it? You should always have a used car checked out by your own mechanic before purchase.

I had two friends with me that are pretty knowledgable when it comes to cars. We all test drove the vehicle and it seemed to be a solid vehicle.

Well, by your own admission, you and your pals approved the paper weight.

I hope you didn't pay too much for the car. You might not be able to get your money back. You can go ahead though & file a complaint with the AG's office in your state, as suggested previously, but I'm not sure how much good it will do. Sorry.
 
I'm not a lawyer, but if it were me I would would approach the problem with a breach of contract in mind. Go over your powertrain contract with a fine tooth comb and see if their refusal to fix the problem constitutes a breach of that contract. If so, sue them for reaching the contract. Simple.
