do i have to leave

my stepfather had me and my wife move from north carolina about 2 months ago.recently he was arrested for choking and slamming my 11 year old brother into a wall.he gets out of jail on nov.23rd.my question is we are not on the lease and rumor has it he is going to turn in his keys and go to a shelter. do we have to leave as soon as he turns in his keys? i have a 2year old and a 5 month old who i don't want on the streets.

You generally have what is called "squatters righs". Are you paying rent at all? Will you pay his rent once he leaves? You might want to talk to the landlord about adding you to the lease, if not, then you still must be given notice that you need to vacate.
