I had funds of my father's in my account for several years which I would transfer to him as he needed money. It wasn't a gift to me but to be used specifically for his care (he couldn't take care of his own finances). My brother and I put it in my account as his wife was threatening divorce so we didn't want her to be able to lay claim to our dad's money. So now I am having to show where the funds went. No problems there as I have receipts and all. I did an accounting providing all my bank statements over the time period with all but the Dad expenditures redacted. I thought that was all I had to provide- the details on the items I am claiming as expenditures for my Dad. But my brothers counsel is now demanding un-redacted statements. In a hearing last Thursday the judge said since I comingled I have to show everything. I cant understand why my family's personal items and my total balance is of concern in this case. why cant I show just the items I am claiming? there isn't a court order on paper or anything - this seems to be an informal county court in a small texas town- but this is what the judge said.

1. is this legal - why do I have to show items on my statements not related to the estate, items I am not claiming?
2. if I do have to show every line item, can I still hide my running balance and possibly even the $ amounts of my personal items? Why should everyone get to see my bank balance and the personal items of my family?

You don't have to do anything, but grow old and die.

If you disobey court orders, the judge could hold you in contempt and throw you in the county jail.

I won't bother explaining why the judge wants this, because you know.

If you don't want to obey the order or don't know why the judge wants this, hire a lawyer and the lawyer will educate you.

I can simply say that if you continue to refuse to disclose, the judge will simply appoint a master, give that master a court order, and he or she will then investigate EVERYTHING financial about you for many years into your past.

Some people choose to do this, to avoid that, and to limit the bleeding.

In what county is this being litigated?

Let me know the county, and I;ll let you know if the judges will do more that I have revealed.

Again, that is ONLY the start of what they can do.

You can be locked up during the pendency of this matter.

So far, I see judicial restraint, but that won' last forever against recalcitrance and intransigence.

Good luck.
