I have been living in my apt. for 3 years now. I have had a month to month lease for the past two years. My landlord informed me, via a letter which she slid under my door, that she sold the building on 3/31/08 and that I must now give her my keys. I had no warning that the building was being sold; I have no money to move presently. I did not believe that I was required by law to return the keys so I did not agree to do so. She threatened to have a locksmith come and change my locks! How much notice is a landlord required to give a tenant before they can demand that a tenant move? Should I be given an opportunity to renew my lease with the new landlord? What should I be doing now?

Thank you for your help.

I don't see where you listed your state as that would help. However what tiem frame did landlord give you to move? It is legal to give you notice to vacate with proper notice (30 to 60 days) depending on state

There was no time given. The note said that she needed me to give her the keys and that was all. I contacted her directly today and she informed me that she needed the keys to give to the new landlord and due to the fact that I told her several weeks ago I may be considering moving soon, she figured that I must have somewhere to go. I informed her that I was thinking about moving soon but had no concrete plans to do so. I don't know when she is planning to send out the locksmith.

Unless the landlord took your comments as a notice you were leaving they cannot remove you without notice. It appears as though whatever you said was taken as notice you were leaving and that could prove to be a problem. Contact a Tenant/Landlord Attorney or your states Housing Authority to find out your rights
