Doctor's scam

i broke my arm and went to the maimonides hospital on 12/22/06 in new york, got referred to a new york doctor on 12/27/06 because of the holiday season. doctors were on vacation. i went to the doctor's clinic, filled out some registration forms, and the receptionist proceeded to make some phone calls to my health insurance company. while she was calling, she handed the phone to me to answer some questions regarding my health insurance. before i could answer most of the questions, i was called into the examination room where two medical assistants cut off my cast and took an xray. then the doctor came in and said that he did not accept my health insurance to cover the arm surgery. i didn't know what to do so i started getting upset and crying. i asked him how much it would be and he took me out into the hallway and said $14,000. i was shocked at the price and started crying again. but the medical assistants saw my distress and took me to the back room where they said they would make me a new cast. they did make me a new cast made of bendable plaster and some velcro strips. my brother and i didn't want the $14,000 surgery so we left.
i went to another doctor and got the surgery on 1/4/07 for only $1500.
over the past year collection letters have been sent to me from the first doctor asking me for $3658.00. i didn't know what he was charging for so i ignored them. and then recently, the last letters were for a summons for civil court. he filed a complaint against me for $3100 pllus interest plus his lawyer's fees. i don't know what to do and would like some advice. i was not yet 16 and my brother was not yet 21 when we went to his clinic. should i fight him? or cut my losses and pay him the outrageous $3100. this doctor had 10 other cases in civil court in the past. the court status' were "disposed." what does this mean? can this be used to my advantage? will this affect my credit rating? and if i will have any fees if i win or if i lose?

Chances are they won't get lawyer's fees in small claims and it will work against them. If the fees for just wrapping your brother's arm are outrageous, then get an estimate from other doctors and bring it into court. Did they ever tell you the cost BEFORE you had the arm wrapped?

You are not alone. I am *incensed* that this practice is still permissible in the medical industry. If insurance doesn't cover something the doctor's office should tell you the cost immediately, not see how much they can take you for later.

That said, if you really have no case then I'm not sure what showing up in court will do. My guess is your best bet is to show up and tell them that the price is outrageous if you believe so, show your proof which will also be the fact that having SURGERY cost only $1,500. From my perspective, and I don't know this area or the details, it would make sense that plastering your arm temporarily shouldn't cost much. Additionally, it was done without knowing the price - and you should make a point of saying that they KNEW the price of the surgery but why didn't they tell you the price for plastering the arm?

So tose might be good arguments but I'm still wondering what I'm not hearing from you. Did you know they were charging you? Think about what the doctor might say that you know is true that you might not be happy to deal with but must. Best of luck.
