My boyfriend was recently evicted from his apartment for not paying rent. I was the co-signer on this apartment and was taken to court with him regarding this issue. The judgement stated that the defendant was to vacate premises by 12/31/07 and pay a judgement amount of $1,029.50. I have been paying on the judgement in $300.00 increments for the past three months. I recently received a statement from the plantiffs stating that I am also responsible for January & February rent because a 60 day notice was not given according to the lease agreement, yet my boyfriend was evicted as of 12/31/07. They are also charging me interest on monies due. Am I responsible for January & February rent as well as the judgement amount or does the eviction nullify the lease agreement? Can they charge me interest on monies due? This took place in Green Bay, Wisconsin.

The original lease wording and the pay or quit notice would spell this out....I would suggest that you are responsible until the property is re-rented and you ex-landlord needs to be attempting to re-rent the unit; however, you should object IN WRITING to the payment of any more money other than the amount awarded in court.
Keep a copy of your letter and if they want the Jan & Feb rent, let them sue in Small Claims court and your argument in that trial would be the prior eviction action in Dec....KEEP YOUR PAPERWORK !!
