Shoplifting, Larceny, Robbery, Theft Does anyone know?

When you are arrested....and the police finger print you, do they immediatly get a list of all priors or can it take days for them to get this info?

I am getting conflicting stories, I was never convicted but may have an outstanding bench warrent in Mi that is 15 years old.

Attorney says if it was gonna show it would have when i was arrested and if it had they would not have let me go.

Is this true or do I still need to worry?:eek:
 
They would have known by now.
Just because they did not serve a warrant does not mean you do not have one though. If the other state was not willing to extradite you then the warrant would remain active until another time when you might be contacted within that jurisdiction.
 
Just don't plan any holidays in MI!

Far be it for me to second-guess an attorney, but what you were told is not quite correct and the reason you were let go was not because nothing showed up, since to run a check, police search through both local and national data bases and are able to tell immediately who is wanted where and for what, so your MI warrant must have definitely shown up on their radar.

You were let go because of the nature and quality of the warrant and MI's unwillingness to extradite you for it due to the very high cost involved. So if MI doesn't want you back, then TN has no reason or interest to keep you locked up. I have seen it up close and personal on two occasions a few years ago when San Diego police released the would-be arrestees who had outstanding bench warrants from cities right here in California.

Now, if the warrant was related to the commission of a very serious crime like murder or armed robbery, then right now you would be going back to MI handcuffed to two marshals. But as it stands, you do not need to worry about the matter at all, unless you have plans to visit Michigan in the future.

Update

So...met with my attorney for the first time yesterday, he says that he still does not think the MI thing will be an issue. He also said he is 99.9% sure that there will be no jail time involved. However he also said that the police may not have my criminal background check back yet, that these things can move slowly. I asked about his finding out what theybhave prior to my court date, but he feels that it would be unwise to go poking in on the police as he feels that maybe the MI thing will get lost in a pile of paperwork and why bring anyones attention to it. He seems to think that he will be able to strike a deal with the DA and that this whole nighmare will be over! I have to say I am still a wreck, I have 2 small children at home and the mere thought of my not being here for them and with them scares me to death!:eek: My husband says relax it will be fine...wish I could and hope it will be. Anywho as always any comments or suggestions are welcome, and thanks to those who have already tried to help. God Bless and Have a wonderful New Years!
 
Nothing to worry about.

Michigan is broke.

Unless your warrant is for a very serious crime (murder, rape, child molestation, armed robbery, or treason); Michigan won't bother extraditing you. As the warrant emanates from Michigan, Tennessee won't have any additional legal reason to harass you.


Follow the advice of your attorney.


I'll say one one more thing, you have the right to STFU. If I were you, I'd take full advantage of that
right. This is no time to start blabbing about anything.

Thank you so much for your help and reassurance.

The MI thing was a result of being involved with the wrong person (My Ex Hubby) and I had done everything in my power to put it behind me.

The thing here in TN was completly wrong....I should not have been arrested, however, live and learn!

I have said nothing to anyone about anything other than my husband and my attorney.

I am just hoping that I will receive community service, probation, etc...so I can get this over with and move on with my life.

I hope all that you and my attorney are telling me is what actually happens.
