Does Husband get 50% of business and intellectual property?

Hi there,

My husband wants a divorce, and tells me he's entitled to everything we own, including me paying him back for the difference in our income for the entire time we were married (he made way more than I did).

Now he also wants 50% of my business. I have a small service business that is an LLC that I invested in, worked on, the whole blood-sweat-and-tears bit. Our accountant advised that I give him 1% partnership of the business for tax purposes, so he does have a little part of it already. Is he entitled to half my business earnings for life?

Also, I do some professional photography and have taken some nice fine art photos that my husband thinks could be sold for a lot of money. He also wants half of any income I can make off those photos for the rest of my life, since they were taken while we were married. Is he entitled that, too?

This is a nightmare :( I'd really appreciate ANY insight on this. Thank you for taking the time to read it.

It doesn't matter what he wants.
You should advise him to communicate ONLY with your attorney.
You don't have an attorney?
HIRE ONE, ASAP!
The worse thing you can do is communicate with him at this time.

California is a community property state.
That said, you have the right to half of the marital estate.
That would be what you acquired during the marriage.
It doesn't apply to what you brought into the marriage.

Do yourself a favor, hire a lawyer.
Stop him now, or he'll bleed you to death!
