me and my girlfriend had got into a fight because she had stop taking her mental meds she was starting to show sines of hallucination wile we was driving and my seven year old son was in the back seat in his car seat. at a block away from are house i told her i was going to take her to the hospital she got frantic and she took her hands of the wheel and hit me wile hitting a parked car then she took of running to the house . after i exchanged insurance info with the owner i drove to the house to find the police there. they immediately put me in cuffs and in the car i asked them for what and they said that i was being charged with dv that she had gave a statement that i had hit her then they questioned my son and they said he confirmed what she had said. now here is were it may take some understanding my son has been raised in the projects were self preservation is learned at an early age and and know very well what happens if both adults go to jail and when asked why he said that he said that he didn't want to go to the crises center now there is a protection order against me from him stating that i can not talk to him about his statement and i feel if he was to try to change his statement to the truth i fear the court may think i co-horsed him into doing it. the girl Friend was committed to a psychiatric hospital the next day also by her family so my question is can my son be questioned and give a statement without permission from me or his mother my charges is domestic violence 3rd degree assault and child abuse because they said i caused the accident there for placing my son in dangerany help with this is very needed thank you
