I am taking my hairstylist to small claims court for damage that was caused to my hair. My question is: In NYS is it illegal for someone that has a license in cosmetology/apparance enhancement, put color/chemical on a customer's hair, while she is drinking wine and eventually becomes drunk?

In small claims court can a defendant sue the claimant for their attorney fee'?
And in small claims court, can the defendents attorney use information from previous cases against the claimant handled in small claims court?
 
You still aren't answering my question - is it illegal for a hairstylist to drink alcohol and put chemicals on someone's hair??

Being illegal or not is not the question as it should be. Did the stylist's drinking contribute to her negligence which caused the damage to your hair? This is the point you would need to make and then it is the judge's decision.

If they win yes. Basically anyone can sue anyone else for anything. Whether they will get it is again up to the judge.

Yes, he/she can try. It would then be up to you to object and then it is the judges decision if it is to be heard or not.

As you can see even my answers are arbitrary. I believe that is why seniorjudge sent you to the NY small claims Google.
 
Generally attorneys fees are not awarded in small claims court but you might want to click on the first link about small claims in new york. If she is drinking while putting chemicals in your hair then it would not be too hard to prove negligence. Also you might want to call the state board of cosmetology and file a complaint.
