Hello everyone.New member here.Okay heres the deal.Last November I plead no contest to a no insurance ticket in Cobb County,Ga.I plead no contest and was given 1 year of "pay and go"probation(pay the fine and probation is over),in addition to the 1 year of probation that I already had for driving in vioaltion of a resricted license(this earlier charge was changed to a basic violation,but I was forced to pay the same fine of $657).
I was told by the county prosecutor,as well as the judge himself,that my pleading no contest would prevent my license from being suspended.The following week I was driving home from work in another county and was pulled over for a brake light.Come to find out,my drivers license was in fact suspended by the Georgia DMV(for 90 days) for the no insurance ticket.I was arrested and spent the night in jail.I was out on bail the next day.The following week I informed my probation officer of the sitation and he thanked me for telling him,and said there was nothing he could do about it.Since then several months have passed,and I have been given two extensions by the court in the county where I work(which is an entirely seperate court from the one Im on probation with,thats what makes these cases diffucult),because they have assured me that if I can get my drivers license back,they will reduce the ticket.However,on the day i was given the second extension(Feb.26th),my P.O. showed up.He told me to come to his office the next day.When I came to his office he set me up for a probation revocation hearing!(Keep in mind that I told him about these charges back in November.)
At my hearing,my P.O.recomended 15 days in jail,but the judge gave me a three week extension,to either get a lawyer or finish paying off my probation.Paying off the probation will not be an issue,so I wont have to go to jail.However,I dont think the court acted fairly in my situation.The judge told me that my D.L.would not be suspended,and as a result,I was driving to and from work not knowing I was committing a crime.I am planning on moving for a re-open and dissmiss of the no insurance charge,as well as my previous basic violation.You see,I was originally charged with driving in violation of a resricted license(I was supposed to wearing my glasses, but i wasn't wearing them when I was pulled over).The court changed the charge to "basic violaton",but still made me pay the fine of $657 and put me on probation.Is this legal?Not only will I move to re-open and dismiss these charges,but I also want all of my money back.Do you think I have a case?
