I was driving with a suspended out-of-state driver's license (from VA) in MD and got pulled over for an expired registration plate. My license was originally suspended for having too many points for getting a number of tickets. However, the police officer mistakenly charged me for being suspended for a failure to pay the fine.

My court date was 7/7/10, and at the trial, the case was filed nolle prosequi.

I see in other cases, for which nolle prosequi was entered, that it may be reindicted.
What are my chances that the case will be brought back at a later date? I had not yet heard from the court regarding the issue.

Thank you for your help.

No one can tell you what a prosecutor will do. That would be predicting the future. You'll just have to wait and see what happens. In the meantime, stop driving until you get your driving privileges restored. Incidents like this get reported and often delay such a restoration. You might also hear from VA about this citation. Not the court, but your state's DMV.

Thanks, army judge. I just wanted to know in general how likely it is that cases filed with nolle prosequi are reindicted. I'll take on your advice and get my privileges restored asap.

Sun714, you're welcome. It's been my experience that if a case is "nolled", that USUALLY ends it. I suspect they're happy that you were arrested and made to worry about this. They got their pound of flesh and are likely to let it go! Good luck, stay safe out there.
