You're insinuating that the prosecution has somehow played "fast and loose" with the rules of discovery.
Before you begin to get excited about a possible prosecution indiscretion, I suggest you discuss your recent revelation with your defense counsel.
In addition, I strongly urge you NOT to discuss this matter with anyone BUT your defense counsel.

The video could mean, assuming there REALLY is a video, the use of an undercover cop (or a snitch, they call them CIs). That could also account for the alleged delay, assuming the case was still ongoing. Be advised, the authorities like to make LOTS of drug cases, not just a rogue or two, here and there!

It would be wise NOT to seek advice over the internet in regards to any possible defenses that exist for ANY felony.
WHY?
You never know who might be trolling these boards.
Loose lips sink ships!

PS: Before you take a plea in regard to ANY criminal matter, think long and hard. It might look like a sweet deal, but consider WHY a prosecutor would want to plead a case if he or she REALLY had the goods on a defendant. Take your case, for instance, if I had ALL of that on YOU, I'd never let you know; and I wouldn't offer you a deal.

I'm licensed to practice in Texas. I've been a prosecutor, a defense attorney, and a judge. I'm semi-retired today, and I only offered three deals in my entire tenure as a prosecutor. Those were only offered when the evidence I had wasn't sound. No one sells out a strong position, no one.

I never fold a hand in poker sitting on full house, a straight, four of a kind, or a flush. I have folded with a pair, two pair, even three of kind.
When you're operating from a perceived position of strength, you never fold.

The prosecutor might have a video, so what? I bet the person who was there knows more than a video could ever reveal. I wish you well, my friend.

AJ are you like a senior judge now, only required to meet a minimum case load to maintain employment? Spending the rest of the year at your retirement home?

I'm retired.
In Texas , you become a visiting judge with no minimum requirement annually.
Some people are ill, frail, or move out of state all or part of the year.
Generally you can pick or choose.
Some choose more to supplement their income, others just want to stay active, and a few wont ever really quit.
