This is a 2 year old matter i just found out about yesterday. I am posting this here instead of seeking professional legal consultation because money is really tight right now and i cannot afford to go to a lawyer. Any help is greatly appreciated.

I went on a trip to Canada with my brother in 2008 and when we got back i foolishly had left my passport in the glove compartment of the vehicle. My brother got pulled over in NJ a few weeks later for speeding and didn't have his license on him (or so he claims). He showed the officer my passport as identification because he thought it was his since it was in the glove compartment of his vehicle. He got served with two tickets and a mandatory court appearance. He never told me anything and since nobody went to court a warrant was apparently issued for failure to appear. I was unaware of all this for 2 years because my brother figured i would never find out about it and it would all go away. Well i found out about it and right now he's laying in bed with a broken nose.

Is there anyway i can take care of this matter without turning myself in? I don't live in NJ and like i said money is really tight right now, i might not even be able to post bail. My brother said he signed something, so can i fax over a copy of my drivers license to the prosecutors office to show them i'm not the individual they served with the tickets since the signatures will not match?

You can contact the prosecutor directly.
Tell him/her your story.
They'll investigate and your brother will catch another case, besides the tickets.
If your story is true, you won't have a case, but your brother darn sure will be in big trouble!!!
You might have one for breaking his nose, however.

Thank you for the reply.

My brother is not pressing charges on me for breaking his nose. He knows he screwed up and deserved what he got. He's been apologizing to me all weekend.

Anyways, how does one go about contacting the prosecutor? should i call the PD?

You can call the PD and ask them for that information. You could also look up the DA's office for the county in which he was charged. You do know that your brother will be arrested and face new charges? He should arrange a lawyer and bail immediately. It would help you if he went with you to speak to the DA.

Yes i am aware my brother will be arrested and face new charges including giving an officer false information. Ive been told for the more serious fraud charge i may be asked if i want to press charges and i of course won't. He's an idiot but he's still my brother.

If my brother has to admit to what he did he will but I am going to see if i can save him. I don't think i need him to admit to anything to prove my case virtue of the fact the signature they have does not match mine. I am pretty sure they can't prove contempt without my signature but I am going to try to get in contact with some sort of legal counsel just to be on the safe side.

Anyways thank you once again for all your help pal, much appreciated.
