I don't see how they can charge the passenger with anything; maybe leaving the scene of an accident with property damage that they witnessed. But they have to PROVE you were driving, and if they can't . . . let them charge you, but you'll get out of it. Problem is, you'll still have to hire an attorney.

Moral of the story: Don't drink and drive. And don't be in a car with someone who is. In my state (NC) you can even be charged as an accessory if you are the passenger. There are some other requirements, but that's something they will do.

Trust me, coming from someone who's done it and been convicted. A DUI will mess you up for years, if not forever. I'm currently in a custody suit, and that DUI is haunting me. My ex's attorney is holding out there as though it's proof that I'm the devil incarnate.

I don't think much will come of this, but you do need an attorney. A DUI charge is nothing to shake a stick at.
