I am currently looking at buying a home. This Property has a defined deed to a parcel "Parcel E" that gives a Ingress and Egress right to the property behind the one I am looking at. The deed also states within the content that parcel E sole legal rights to use this easement.
Now my questions are:
1) Due to the fact I will be paying taxes on this property and the easement is on this property. Do I have the right to use? Reason; This is the only access to the full length of the property and I would like to build an outbuilding off this easement, that will allow me to leverage as easy access to the outbuilding. Mind you I will not block the easement. I simple what to use the property I would be paying for anyway...
2) What are liabilities of this easement? Is this split between the owning property and parcel E that has sole legal rights or would I be liable for everything due to the fact it would be under the owner property?
3) I have the real estate agent from the seller is trying to get me to sign a Addedum to the purchase agreement that the Property is for the exlusive use of Parcel E. What's up with that?
