I have a situation for which I'd like legal advice.
I purchased some computer components(motherboard, processor, memory combo) worth $1,217 online from an eBay store based in Ridgefield Park, NJ while in Africa-Kenya. This was in June 2010.
A month later I had still not received the items, so I filed an eBay dispute for item not received. Seller responded with a tracking number which I used to track the item in the post office. I successfully found the package-it was being held because it did not have an addressee nor any contact information. I have no idea why the seller had failed to put it.
I was however happy to finally receive the package thinking the ordeal was eventually over. Little did I know this joy would be short-lived. I opened up the package only to find a worthless Windows Vista CD which of course I certainly never ordered.
I went back to eBay and filed an "Item not as described dispute". The seller promptly responded saying he will issue a full refund after I returned the item. I quickly shipped it back using express mail international which cost me $60. Three days later I checked the tracking status and it said "package refused". It was sent back to me.
Time was running out so I escalated the dispute to a claim to which eBay ruled in my favor. However, as circumstances may have it, my PayPal account was limited at the time. Ebay said they gave me 2 days to resolve the issue before they could send the refund. I quickly contacted PayPal to explain and they said my account was in a position to receive the refund so eBay could go ahead and remit it. I relayed this information back to eBay (as you're probably aware, with PayPal limitations all one can do is submit the requested documents and wait which I had already done).
Four days later eBay sent me a message saying I had lost the case and it was now closed. A week afterward PayPal removed the limit and I appealed the eBay dispute. They responded after a few days saying their initial ruling stood since I "did not comply" with their instructions to bring my PayPal account to good standing-and advised me to report my case to local authorities, BBB and ic3.gov.
A quick check still shows his business is still thriving on eBay. Whenever I call, the person I dealt with (Nick) who sounds of Chinese descent, tells me he no longer works for the company-even though it is his number that is listed on the website!
Please point me in the right direction towards recovering my money or having the seller send me what is rightfully mine.
