Below is the message I just sent to ebay as I have someone who entered into a contract and has not paid for the item. Please see details below and give me your opinion of what I should do?
Back in January, I had listed an item for sale on a free web page forum and a guy by the name of Vince called me inquiring about the product. He called me several different times and I informed him about the product, shipping and payment etc...One day, I decided to list the item on ebay because nobody was selling the item. After doing this, I called him and told him to check out my listing so he can again view all item details, pictures, payment information and if he liked it, he could buy it as he would have ebays protection. He then went on ebay a few hours later using his friends account and bought the Strut Zambezi grille for an H2 hummer I was selling for $4300 shipped. The day after he bought, he said that paypal would not up his limit and that he would send a money order in a week or so. The next week came and he had not sent it yet so I tried working out other payment options with him such as sending me $3000 using paypal(this was his limit) and then send the rest money order. He said ok and then another week or two went by and then he told me that he no longer had the vehicle. I then called him and gave him another chance to pay and I told him if he did not pay I would file a claim with ebay. I then had to file a claim as I was charged a $120.00 fee for the item selling and due to the fact I have not been able to pay that amount my account has been suspended. I have called him again since my account being suspended and I informed him that if he did not pay me within one week I would take him to small claims court. Also, when I filed my claim he had stated that I he was suspicious of buying from me and made up lies that I was trying to get him to buy over the phone which is untrue. I simply tried working out another payment option to help him since he used his friends account to enter into a legally binding contract. My questions are these: Since he used his friends account, his friend is liabale for the payment correct? If so, I cannot gain access to my account to get that user id but I believe it is something like Jess491 or something close to that. Since this is a legal contract, he will no longer answer my phone calls and I would like to know how I can get the contact information for the above user id so that I can file a small claims order to get my money. Also, do you know of any lawyers who deal with small claims from ebay sales? Any help would be appreciated as this is alot of money and he knowingly entered into a legally binding contract verbally and via purchasing the item via ebay. I have been more than nice to this guy about this and bending over backwards to help him pay. And if he did sell the vehicle, he should have never bought the item. Please help!
