This boat was listed as being in GREAT SHAPE. Even on the NADA website in the explanation of value, it says that a "great" condition boat would have no visible damage or defects and be in complete working condition. I have written communication where I specifically asked about the condition of the boat and did not receive a response. My husband called because there was no written reply, he was told we would not be disappointed. The boat was in excellent condition. There was little detail in the listing of this item. To be described this way, I would assume everything was in working condition. Yes, the pictures on the listing are good and make the boat appear to be in perfect shape. But if I were listing this item, I would explain all of the smallest issues and take pictures of those issues and post them. There was no disclosure of broken/not working items, tears/rips of the interior, fiberglass cracks/holes, stained carpet & interior, or the missing seat cushion.
The radio does not work nor does the depth finder. Neither of these were disclosed to us until we drove over 6 hours to pick it up. In addition, there is a seat cushion missing from the boat, which if there are missing parts, shouldn't that be disclosed in the listing also?
There are SEVERAL cracks/hole in the fiberglass of the boat, including 4 star cracks in the hull of the front of the boat (not disclosed) that we didn't even noticed until we stopped for gas on the trip back to Iowa from Wisconsin where we picked up the boat. One part of the interior is completely torn in the front bow of the boat, which was not disclosed. The seats and carpet are stained, which was not disclosed. When we arrived to pick the boat up and inspected the various defects, we tried to tell them we were not happy with the condition or the description that was given online. They were very threatening and would not work with us at all. Tim said the boat is being sold as is, which I understand, but this boat was not advertised truthfully. We even asked what we could do to NOT take the boat. We offered them $500 for their time, but this was not an option to them. They were threatening legal action and would not work with us at all. We are working to get estimates for fixing the hull cracks in the fiberglass.
Do I have any legal avenues?
