eBays new top rated seller program is a complete nightmare. The verbage they write about it implys that the 5 star rating is harmless and it is not.

Anyway, I received two low scores by someone by mistake. The customer wrote to eBay and asked them to remove it but they refused. They told us that we would have to get a court order to have it removed.

To me that sounds really rude and degrading almost like they are laughing at us. So now I want to get a court order to have all negative items on the grounds that it is preventing me to compete fairly in the market place and has cause me to suffer an increase in fees. I would also like it removed on the grounds that the customer either left it by mistake, changed his mind or simply had no idea that it would cause me so much harm.

This is not an action against a person but eBay. HOW DO I GET A COURT ORDER? Can't I just put in a request to a judge or something? What would I need to do to make this happen. Is eBay allowed to say that?

Pease advise. I just want my monthly discount which eauals up to $300 a month reinstated. Thank You

You would have to sue ebay for liable in California or in Federal court. It isn't easy. You could if you want, write a letter to their registered agent and possibly accomplish the goal. I could help you do it but it would be a bear.

At this point I figure it is going to cost me $300 a month for a minimum of 6 months so I think I am willing to try anything. What is a registered agent and what do they do?

Thanks for your help.

The registered agent is your contact person for legal matters with the company.

There seems to be something significant missing here though. There must be more information regarding their reason for not removing the derogatory marks after mutual consent.

Yah, they said that there policy states there are only two reasons that they will remove feedback and this was not one of them. One would think that mutual consent would do the trick but they feel that will cause sellers to harass buyers until they comply or something like that. My buyer said it was an error but they just don't do it.

I did discover something else however. It states in their policy that they calculate the scores based on total transactions however they have not been doing that. They have been basing it only on the number of people that leave feedback which for me is 100 less and does mean the difference of me qualifying. I sent an email to my account rep. and am waiting to hear back. This however does not negate the original problem in general.

How can I go about finding the legal contact at eBay? Thanks for all of your help,
