eBay supported fraud? Need 3 lawyers?

I bought a fraudulently misrepresented Caterpillar bulldozer off a seller at eBay who is in Maryland. Tried to return it within their 7 day return policy (as per their listing) and they wouldn't accept the return.
I filed a buyers protection insurance claim with eBay's third party insurance company. The seller sent them a check right near the end of the 30 days. Per eBay buyer protection policy the claim will be resolved within 30 day.
The insurance company said it was settled within the 30 days by sending me a picture of the front of the check.
Then the insurance company tried to take possession of the dozer by lining up a shipper to pick it up. Without sending me anything.
Refusing to release the bulldozer with nothing. They sent the sellers check. It is considered defaced and has unrealistic impossible terms on the back. The bank says it couldn't even be deposited.
eBay couldn't care any less because the claim is in the hands of the insurance company. Even being well over their written statement will be resolved in 30 days.
The insurance company seems to be solidly in cahoots with the crooked seller. When the seller thought he was getting it back he already had it re-listed under another user name at eBay. The ad was toned down some but still very fraudulent.
The insurance company is is Alabama, the seller is in Maryland and eBay is in California. I'm sitting in Virginia being victimized by all of them.
I'm lost in a legal maze.
Any suggestions on the best way to pursue some justice in this matter would be greatly appreciated.

Did you recontact the insurance company? Do so, with a written statement from the bank stating the check was untenable. Send return receipt, keeping copies of the letter and bank statement.
 
Yes I did re-contact the insurance company. I was informed the seller would re-issued a check for the bid price provided if I agreed to no further litigation allowed, full and final settlement. This leaving me out 1000s on shipping, a Caterpillar mechanic checking it out, etc.
It has always appeared to be a need for a immediate decision from the pressing insurance company trying to avoid their written obligation. To pay up to the bid price in repairs on only the items that would deem the machine inoperable.
The items deeming the machine inoperable are slightly below the bid price. They just don't want to pay.
Well I did not respond immediately. I have had enough of their games. Endless months of them. So I would guess that offer is now off the table. So now I'm still stuck with my lawn ornament of fraud of which I can't even turn the scoop up far enough for a bird bath.
My idea is to get the insurance company to live up to their written obligations listed by eBay at eBay.
As far as the seller goes at this level of fraud my opinion is he should be in jail. Not able to re-list the item again to fraud another via eBay. Of which eBay knows the extent of fraud.
Furthermore I think he should pay for the items repair listed as perfect per eBay listing. Which do not deem the machine inoperable. My return item refusal to accept the item, shipping charge also should be refunded I think.
How about eBay living up to their written words also? Everyone involved seems to be very wrong here to me.
What's a person to do?
