Hello, I recently sold an item on ebay, received the payment thru paypal, mailed via USPS priority mail with a tracking number to make sure the package arrived and insured the item. The USPS website says it arrived at the zip code I sent the item. But the buyer claims it never arrived and is getting irate .I have sent the buyer all the USPS website evidence that it arrived and have checked at my post office that it arrived. Also phoned the delivering post office to confirm it has been delivered. I can do no more, but the buyer is adamant that I have to fix this . The post office will not let me submit the claim form as they can see it was delivered and said it would be postal fraud to attempt to claim. The ebay and paypal case that the buyer raised were closed as they were opened too late. The buyer is now contacting Visa to see what can be done and the email language is threatening legal action, can a case be brought against me ? Thanks, Iain.

IMHO, I'd tell the buyer to go ahead and call Visa if he feels so inclined but they will likely tell him something that, to me, seems common sense. If the USPS says they delivered the package to him then he has to file the complaint. As far as Visa is concerned, they will investigate and see that on the record the buyer received the package. The buyer must complain that the USPS didn't deliver and fill out a form to recover from them. After all, couldn't everyone just claim they never received a package, keep it and walk away? Explain to the buyer that the presumption is that the package was delivered and that it's his/her responsibility at this point to dispute that fact. I wouldn't be worried about a lawsuit, at least not in my experience and I don't know if there are any other details in this case. Good luck.
