emails hacked into

i am going to use an anolgy of what is going so that the people who are truely involved in this case are safe.

person 1 is a male in the army
person 2 is a female in the army
person 3 is the males wife

alright so person 1 and person 2 have a small fling that no but them knows about. because they are in the army it is considered adultry and is punishible by quite alot of things. person 3 hacks into person 1's yahoo email account, and myspace account and finds certain emails that could be a give away that something might or might not have happened but nothing really outright. person 3 has a literal cow and goes to tell the CO about what she has found but only after person 1 tells person 3 that he wants a divorce.

i know it is a little bit confusing but i was wondering can person 3 use those emails that she obtained without permission as evidence in any form of trial, both military and civilian?

i know it gets asked so let me just answer it now. person 1 didnt leave his password on the computer she used, he was in kuwait when she did all this. and the day before she found all these emails he changed his password while person 2 was watching so there was no way that he was giving her access.
 
Stolen items are generally not allowed as evidence in civil trials.
 
still confused though

like i know that normally the emails cant be used but is there some way that they could be when it comes to the military? i know the army has a different set of rules to it and what not.
