I plan on getting emancipated after I graduate highschool at 16. After which I plan to marry my boyfriend who is in the Marine Corps; he's 19. Would that be legal in California?

Or

If I get a judge's consent to marry instead of getting emancipated, would I still need parental/guardian consent?

On what grounds do you think a judge will approve EITHER emancipation OR marriage for a 16 year old? You do realize that emancipations are about as rare as true sightings of the Loch Ness Monster, right?

Well in the state of California it would be better for you if you got married, because that automatically emancipates you. but if your parents give you permission to be emancipated you are not allowed to get married still without their permission. to get married in the state of california at least one of your parents/legal guardian, must appear with the couple. Certified copies of birth certificates are required. The couple must also schedule an appointment with a counselor and then appear before a California superior court judge.

This is a "chicken or the egg" issue. A judge is not going to emancipate her so that she can get married while under age; nor is a judge going to override her parents wishes and allow her to marry against their wishes so that she can be emancipated.

If her parents consent, fine. If not, she may as well wait till she's 18 because the law is not going to override her parents.
