I have a friend that has taken money from his place of employment. Nothing has been said, but he's almost certain that when they invetory, he will be caught. Now it's not a ridiculous amount of money. Probably around a grand. He has no prior record, other than two counts of underage consumption, but this is his first position of authority. He currently works there. Any suggestions on the best way to go about this. What's done is done, he know's he is trouble. It's just he think that he's in a position where he can maybe ease his punishment. Seeing as how nothing has taken place. Also, if he leaves and finds another job, could they fire him because he is convicted, but doesn't do any time? Your advice will be greatly appreciated.
 
If theft dollar value is $1000.00 or more its a felony! Not sure what your question is about restitution? He will have to repay his employer for their loses so I am unsure what your asking.
 
I apologize for not understanding how the system works. Or the correct terms to use. Someone mentioned it to him. They stated that it was a chance for him to pay it all back..
 
He hasn't been. This was just from a family friend. They just mentioned it. Apparently they didn't have a very good understanding of what restitution meant either.
 
If you want to help your friend do not accept advice from the uninformed. Here is my advice on how your friend should deal with this

1. Start looking for new job. Send out resumes etc. Long as he has not been charged or fired for theft he does not have to divulge this in an interview or on any application
2. If called into Loss Prevention Office or mangement Office. Do not answer "any" questions! They want a confession do not give it to them. Its possible they lack enough evidence to file criminal charges a confession gives them that evidence. They may offer you a deal to confess no charges etc. Ask for a few days to decide and talk to your lawyer
3. If Police are contacted remember you do not have to answer "any" questions without an Attorney present. Police can be tricky and get you to answer questions before custodial arrest when miranda does not apply. Again answer no questions in fact request an Attorney. Once you do that Police will cease asking you anything!
4. He can agree to repay store but he can do so without admitting guilt in order to protect his job or exchange the repayment for employer not filing criminal charges. Get this deal in writing and do not violate deal. Example if repayment is to occur within 30 days this means 30 days not 31! He might even offer to repay through wage deductions.


Remember if he is called in then they either have enough info to know it was him or they strongly suspect it. Regardless he should not admit to anything! Loss Prevention is no ton his side even if they had a friendly relationships. Internals are biggies with LP and BIG feather in their caps. LP does not have his best interest at heart.
To sum it up. He does nothing for now but should start seeking new employment before poo poo hits the fan. If a job offer comes around he should take it. He has no clue when or if the theft will be discovered or if they will find out its him. If he is no longer working there and they lack evidence for criminal case they may just leave it be. If he is still there they will no doubt want to talk to him. If questioned by store or Police he answers no questions and admits to nothing! Last if a repayment plan is offered and he find sit acceptable he can agree but he needs to get it in writing and follow it to the letter.

well, he made a false return, and nothing came of it. So he got greedy, and took it too far. so there is computer trail. When shrink is higher than normal, the items that were supposibly returned will probably red flag with his number being the one who returned them. Also, say he does get a new job, if he's convicted, but avoids jail time and has to pay it all back, will he be terminated from his new employer for being criminally liable?
 
Unless he has a cba or employment contract that says otherwise he is an employee "at will." This means he can br fired for any or no reason that does not violate any existing law or previously mentioned contracts.
