emotional distress to cancer sufferer

my husband and our family have been harrassed at different times by his son's mother. she recently got our number and left 2 particularly vile messages. calling us obsceneties, and telling my husband he deserves to die, he needs to die, etc. i was devastated when i turned on my answering machine this morning. my husband is very ill with lung cancer and is undergoing chemo. this is a very sad, stressful, scary time for him. i heard she came into some money and we have no problem with sueing her for distress or damages or whatever. this is totally unacceptable and she needs to be penalized for her cruelty which very much interferes with my husband's progress, especially when she insists on bring the son into it. i'm taping these latest recordings. help! what is our recourse?

can i sue for emotional distress or damages to for a person who calls and leaves vile, vulgar messages to me and my husband? he has cancer and one of her messages i recorded is specifically directed toward him adn how she thinks he deserves cancer and other terrible things. the names and words she uses are extreme vulgarities. i'm talking the P word, etc. this isn't the first time we've been harrassed by this woman, but i want to make sure she thinks about it before doing it again. i want her to pay. she lives in another state and recently came into some money. she needs to be penalized. my husband and i certainly do not need this vicious stress especially at this time when we're trying to save his life. d. adkins
