An employee who has worked here for 5 yrs. quit last week. When asked why, he admitted that he's been using fraudulent IDs. He now wants to go legit and use his own name and IDs. Can we hire him back under his real name? Will this cause problems with ICE or Social Security?
Because he's a good worker, never misses work, always ready to help co-workers, and he's an expert on our machinery (both running it and fixing it). Losing him put a big dent in our production. We'd rather have him come back than hire someone new who would have to be fully trained.
If he is now legal and has genuine papers.................You will be okay. The current immigration system has not yet offered a system to verify so you will not be liable for the first hiring.........you were tricked. New penalties on hiring someone using ID fraud are quite tough in many states now. If you want to be extra careful, let him go.
