I had to let an employee go: he was a floral delivery man: 5 yr... He had an outstanding bill of $100 for a weeks delivery... As he left: he actually stole my large delivery foam ( piece for back of van transport flowers etc...).... A week later: he came for payday: I explained that I'd have to deduct my foam from his pay... & I'd get price & settle up with him... J
He never offered to return it.. ( he took it to another shop).... I paid him $70 with the $30 deduction of my new piece ( being made) .... Next day foam returned to my door & he claims he's suing me... ? He has not cashed $70 check yet.... ? What should I do.. Really don't have time for this.... But don't want to fight:: he kept stolen property for 3-4 weeks...? Thanks...

As my colleague "cbg" stated, Ohio (and many other states) don't allow deductions form emplyee paychecks with express written agreement and signed acknowledgment and authorization for said deduction.

You could have sued him.

Yet, you using self help (I NEVER RECOMMEND SELF HELP REMEDIES) has allowed him to sue you.

By the way, he'll prevail.

This link explains what you can do under Ohio law, regarding deductions:

Hopefully, reading this will help next time:
