My wifes doctor recently restricted her to a 4 hr work days to to pregnancy complications signs of preterm labor. When she notified her place of work they told her she would now be considered part time and would lose all of her employee benefits (vacation, medical insurance, sick, holiday pay and maternity leave) Is she considered part time with this being a temporary medical disability? Can they cancel her maternity leave? Please help I am unaware of her rights.

If she is hourly (and needs a minimum amount of hours a week to qualify for benefits) if she falls below the minimum hours required, she will lose them.

It's a little more complicated than that. There are a couple of laws that I have in mind that might be violated here, or might not. Presutin's answer is correct as far as it goes, but it's not the entire answer and depending on circumstances that may or may not exist, cancelling the benefits might be illegal.

Please answer the following questions:

1.) How long has she worked for this employer?
2.) How many employees does the employer have within 75 miles of her location?
3.) In the last 12 months, has she worked a minimum of 1,250 hours?
4.) How much time off has she missed due to the pregnancy so far, if any?
5.) Have other employees who have had to go to part time for non-maternity medical reasons also had benefits reduced or eliminated?
