I have been out of a disability leave since March 1, 2010. My employer's 3rd party Disability Insurance provider paid me a month's worth of disability pay and then made the determination that I was not disabled.
My employer has paid my share and the Company's share of my health insurance premiums and then in December 23, 2010, they send me a letter stating the following:
1) My disability leave is not covered under FMLA and I owe all premiums they paid since April 2010
2) They provided an option to allow me to opt in our out of health insurance coverage beginning April 2010. They then gave me 1 week to pay the bill which was over $4,000
After talking to HR, I discovered this was because their 3rd party Disability Insurance provider determined I wasnt disabled and a 6 month appeal window closed.
After telling them that I was in fact disabled and have been seeing a doctor since I left for disability, they basically told me I had to pay the full amount of premiums or they will send it to collections.
Is it even possible for them to send this to collections? I never agreed to, signed ANYTHING, let alone anything discussing who pays insurance premiums while on leave.
If I go back to work for this employer, can they garnish my wages if I don't pay this back
