I live in Ohio. An employment recruiter contacted me after seeing my resume on the internet. This recruiter found a job for me with the abc company. It is temp to hire. So, technically I am an employee of the recruiter for 5 months. Then the abc company hires me directly.
The recruiter charges a fee to the abc company based on my gross wage each week.
Every Monday, I fax my time sheet to the recruiter so they can process my paycheck. My fax machine gives me a transmission confirmation so I am certain my recruiter has received my timesheet.
Here's the problem: For the FOURTH time in FIVE weeks, the recruiter has lost my time sheet. I have proof of submitting my time sheet and I deserve to be paid in a timely matter. So, here I am on a holiday weekend with only $10 to my name and no one can tell me when I will receive my paycheck. Failure to receive my wages in a timely manner is grounds for submitting my resignation.
Therefore, I terminated my employment with my recruiter. I will not continue my employment with a company that habitually loses my time sheet.
Just because my employer is irresponsible, I do not want to lose my position as Controller with the abc company. The abc company has hired me directly as of today.
I did not signed a contract with the recruiter and neither has the abc company.
My question is, does the recruiter have any legal course with me or the abc company?
