After diagnosed with cancer, I started my 12 weeks STD under FMLA. Afterwards, my employer gave me extra 10 weeks unpaid leave after I provided proper medical document. I was asked to start working on 7/22, but since I'm still receiving treatments oversea, I'm unable to return to US immediately. I asked if my employer is ok with me working remotely in the meantime (which they allowed me to do for a few weeks last year; I am in communication industry, all I need to be able to work is a laptop and phone.) They then refused my request and terminated my employment, stating that they can't accommodate this due to time difference between US and where I currently live. My employer is a large firm (over 300 employes.) I'd greatly appreciate if someone could advise me whether my situation warrants getting help from an employment lawyer. Thanks!
 
No, it does not. You received all the time you are entitled to by law plus an additional ten weeks. The employer is under no legal obligation to return you to work at this time. regardless of their size.
 
Agree. Sorry but your job need only be protected for 12 weeks under FMLA & you were even given more time that.
 
Your former employer went above and beyond what FMLA mandates, OP.
This is an example of an employer that exceeds what the law requires.
If I were in their employ, I'd be very grateful.
I commend your employer for helping you.
