Should my husband and I do our will? Someone told me if he were to die unexpectedly I may not be entitled to our estate, and his sister could try to claim it if he doesn't have a will. I live in NJ, I have been married for 13 years. I have a 12 year old daughter. My husband is an alcoholic with liver problems , and we are in our 50's. He continues to drink, I am also going to seek counsel for a divorce. I always thought the surviving spouse is automatically entitled to the estate of the deceased spouse. I would appreciate some advise.
