Thanks for your help. I go tomorrow for the equitable distribution mediation. My attorney said I am not able to claim any part of the worker's comp lawsuit my husband won. I didn't want it to start with, but he is wanting half of my profit sharing plan and he wants me to pay spousal support. He did not want to work for over three years while he waited for disability and the lawsuit. He was very much capable of working. Wouldn't the loss of income from this entitle me to a part of his lawsuit? I want to claim the equivalant of what he's trying to take from me. He was emotionally abusive to me for all the years we had been married and I finally got the nerve to tell him I didn't want to be his wife anymore. That made him really angry and bitter and he is only trying to get me back. My family (and myself) are afraid for my safety. Am I up the creek?

You may not be up the creek, but you'll never see a dime of his disability benefit.

I suggest you attend the hearing and follow the advice of your counsel. That is why you retained his/her legal services.

I never wanted anything from him except he would go away and leave me alone.

Thank you for your assistance; I do appreciate it.
