If an Executor of a Will Contested the Will for her own personal gain, should she have REMOVED herself as the Executor? Should the Estate Attorney have told her to do so? and if the Estate has NOT yet closed, is it too late to File and have her Removed and have her Return the Fee of $9100.00, that she has already paid to Herself, put Back into the Estate?

Your questions are best asked of one of Iowa's fine attorneys.

(By way of personal disclaimer, I went to law school in Iowa. To me, all Iowa attorneys are the best on the planet!)

You left out times.

Some of your answers are time based.

At this point i just want to know if i can ask the judge if i can file papers to dismiss her as executor.
Please give me your opinion?

Of course you may ask.
It depends on what the statute says in your state.
In many state's, such a request is time limited.
It could be 30 days, 90 days, or even a year.
Research the statute in your state.
If you can't find it, and you're bound on asking, do so.
The worst that could happen is the judge says, no!!!

It has been many years since I've practiced in Iowa.
If I knew the law today, I'd tell you.
