I know this is long, but i feel that a more detailed explination would help me get a better answer.
A friend of mine is being charged with evading (i think that they are trying to charge him with two counts of evading). It was 4am in the morning and he was heading to work. He was on a sport motorcycle and going 61 in a 35. It was in winter and was cold outside (he said about 30). My friend made a few turns and stopped at his fathers house before continuing to work. He got off his bike and took his golves off. The police officer turned onto the street that his father lives on (the house was on a corner) with his lights on and drove past my friend and down a dirt road out if sight. My friend got back on his bike and started to go to work. When he turned back onto the main road, a different police officer was facing him and turned on his lights. That was the first time that my friend knew that a police officer was trying to pull him over. The police officer that caught him doing 61 in a 35 said that my friend turned back and looked at him when he was turning around, but my friend's helmet was closed and was fogged up so he was looking away from headlights so he could see and not have an accident. My friend was also listening to an IPod and had his helmet on. The second charge of evading is from the second police officer that pulled him over. The road that my friend was on goes into another county about 2 miles past where he was speeding and where the police said he started evading. He could have easly out ran the police and into a different county if he was trying to get away.
My friend saw that the police officer that arrested him had a vido in the car and re winded it too look at the video while my friend was in the back of the police car. They now say there is no video and they are offering him two years of Deferred Probation.
My friend only has a few speeding tickets on his record.
Is this a good deal for him to take or should he take this to trial? If he takes this to trial does he have a good case to win? If my friend saw a video and there were two police cars there wouldn't one have a vidro on in their car?
