Evict a family member

Hi. My inlaws have a house with an extra apartment where his sister (husbands aunt) been levaing for more than 25 years, she pays rent some times sometimes she doesn't, and she pays any amount she wants. There was never a lease or any contract they just let her leave there. But now my husband and I need a place to go and they ask the aunt to move out. But she doesn't want to go she says that they have to pay her to leave the house is that legal is there any way to make her leave. What can we do?

Unless there is some right she has to live in the house, you can evict her. You want to provide her with reasonable notice as per the state law and take her to court for an eviction proceeding if she refuses to leave. Her defense will be that since someone paid her bills for years she should be able to continue to have them paid. You can be rest assured a judge will love that one and the proceeding should move quickly. Good luck and sorry to hear about the issue.
