Evict Tenant

Tenant moved in Dec 2nd 2009. Was supposed to pay electricity per lease. Didn't transfer so LL got bill for $198. Refused to pay Jan rent or electric bill. Shut electricity off and am wondering how I can get tenant out before pipes freeze. Already started process with 10 day letter. Can file in small claims on Jan 15th but that is a week away. Not sure that the pipes won't freeze. Anybody been through this?
 
If the tenant didn't shut the electricity off you probably are not allowed to. I say probably because they are suppose to have the utilities in their name, but depending on the state law you can get in a lot of trouble for shutting off their utilities.

I personally would turn them back on, and continue with the eviction process. Next time you get a tenant, stay on top of them getting the utilities in their name. Most places I know make you prove that the utilities are in your name before you move in.
