My jurisdiction is: Utah
We moved into this Apartment 2 yrs. ago, had a 6 month lease (which expired Jan. 08). We did not do another lease, so we are 'month to month'. (?) This last month a relative from out of state was in need of somewhere to stay, while looking for his own place.
He stayed 3 weeks, at this point the landlord said he could no longer stay here. (due to the fact hes not on lease, and lease states that guests can only be here 3 days) He found another place, but came over here during day time. The landlord came over, infuriated, said he couldnt live here. We 'tryed' to explain he wasnt, just visiting during day. Landlord called police, had him 'trespassed' off property. The next morning we recieved a 'voicemail message' from landlord saying we violated our lease, and to "consider this your 30 day notice, be out by July 1". I guess I understand with a month to month~ that a landlord can do a 30 day eviction, but,,,is it a legal eviction leaving it in a voice mail over the phone?? I dont know what to do! I've never had something like this happend.
