What is the legal notice for eviction from a residence in South Carolina? We do not have a lease but have lived in the house since March 2006. We pay rent on a monthly basis.

Our landlord inherited the house from her grandmother. She recently took out a mortgage on the house and isn't able to make the payments due to her inability to manage money. She is on the verge of loosing the house and wants to sell it. She owes more on it than a bank will loan on it, and we don't have that much to pay down to purchase it ourself. The house is in need of alot of repairs, mostly small things - the major repair needed is a leaking roof in one of the bedrooms.

The landlord came by tonight and gave me a letter stating we have 5 days from today to vacate the property. Doesn't she have to give us 30 day notice since we rent the property monthly?

If you have done any of what is described here as grounds for eviction, your landlord will give you a 5 day notice to vacate the property. Failure to comply with this or remedy the situation (for example, paying the rent if you have failed to do so) will usually result in the next step; filing for eviction through the court system.
